1. Agreement to Terms

By accessing or using Nos Tumba (the "Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Platform.

2. Service Description

Nos Tumba provides streaming access to Festival di Tumba content, including:

• Past Tumba festival performances and videos
• News and updates about Festival di Tumba
• Live streaming of Tumba events (with Tumba+ subscription)
• Exclusive behind-the-scenes content and interviews

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 13 years of age
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access

4. Subscriptions and Payments

4.1 Tumba+ Subscription

Tumba+ provides access to:

• Live streaming of all 4 Tumba Nights
• Full archive of past performances
• Exclusive premium content
• Ad-free viewing experience

4.2 Payment Processing

All payments are processed securely through Sentoo Payment Gateway. We accept:

• Credit Cards: Visa, Mastercard
• iDeal: For customers in the Netherlands
• Sentoo Pay by Bank: Pay easily and securely with your banking app. Available for bank accounts in Curaçao with APC Bank, Banco di Caribe, MCB, and Orco Bank.
• Vouchers: Available at authorized retailers (e.g., Tu Y Yo Lottery)

4.3 Billing

• Subscriptions are billed in advance
• Prices are listed in XCG (Caribbean Guilder)
• Subscription automatically renews unless cancelled
• You will receive an invoice for each successful payment

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

4.5 Non-Transferability

Subscriptions are personal, non-transferable, and non-assignable. You may not sell, trade, gift, or otherwise transfer your subscription or account access to any other person or entity. Any attempted transfer shall be null and void and may result in immediate termination of your subscription without refund.

5. Refund Policy

5.1 General Refund Terms

Refunds may be considered prior to Festival di Tumba event dates under the following circumstances:

• Technical issues preventing service access (verified by us)
• Duplicate charges or billing errors
• Request made prior to the commencement of any Festival di Tumba live event

5.2 No Refunds During Event Period

Once any Festival di Tumba live event has commenced, all sales are final and no refunds will be issued. This policy applies regardless of:

• Whether you have accessed or viewed any content
• Your location or country of residence
• The amount of content consumed or time remaining in your subscription
• Personal circumstances or change of mind

The "Event Period" includes all scheduled Festival di Tumba nights and extends until 48 hours after the final scheduled event.

5.3 EU Consumer Rights

For EU residents: Under the Consumer Rights Directive (2011/83/EU), you normally have a 14-day withdrawal period. However, by purchasing a Tumba+ subscription, you expressly acknowledge and agree that:

• The digital content service begins immediately upon successful payment
• You expressly consent to the immediate performance of the service
• You acknowledge that you lose your right of withdrawal once the live event streaming service has commenced or any premium content has been accessed

Prior to any event commencement, EU residents may request a refund within 14 days of purchase, provided no premium content has been accessed.

5.4 Refund Request Procedure

Eligible refund requests must be submitted to support@nostumba.com within 7 days of the charge and prior to any event commencement. Include your account email and reason for the request. Refunds are processed within 14 business days to the original payment method.

6. Acceptable Use

You agree NOT to:

• Share your account credentials with others
• Download, record, or redistribute our content
• Use automated tools (bots, scrapers) on the Platform
• Circumvent geographic or technical restrictions
• Restream or broadcast our content publicly
• Reverse engineer or attempt to access our source code
• Upload malicious code or viruses
• Harass or abuse other users or staff

7. Intellectual Property

All content on the Platform, including videos, music, images, text, logos, and software, is owned by AMAK, Festival di Tumba, or licensed content providers. Content is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

8. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Restream or redistribute our content
• Provide false information

You may delete your account at any time through account settings. Account deletion is permanent and cannot be undone.

9. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We are not liable for service outages, technical issues, or third-party failures (including Sentoo payment processing).

10. Limitation of Liability

To the maximum extent permitted by law, AMAK and Nos Tumba shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the past 12 months.

11. Governing Law

These Terms are governed by the laws of Curaçao. Any disputes shall be resolved in the courts of Curaçao. EU residents retain their consumer rights under EU law.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
